VETOES

AN ACT concerning

Recordation and Transfer Taxes

FOR the purpose of eliminating payment of recordation and
transfer taxes on certain transactions to the extent
that the consideration for the transaction consists of
express or implied assumption of a mortgage;
eliminating payment of recordation and transfer taxes
on certain transactions connected with separation
agreements; and clarifying language.

May 29, 1979

Honorable James Clark, Jr.
President of the Senate
State House
Annapolis, Maryland 21404

Dear Mr. President:

In accordance with Article II, Section 17 of the
Maryland Constitution, I have today vetoed Senate Bill 164.

This bill exempts from State transfer and recordation
taxes, the amount of an outstanding mortgage, on jointly
held property which is transferred as part of a separation
agreement between spouses or former spouses; and also
exempts transfers of property other than money or evidence
of indebtedness from these taxes, under the same
circumstances.

House Bill 803, which was enacted by the General
Assembly and signed by me on May 29, 1979 accomplishes the
same purpose.

Therefore it is unnecessary for me to sign Senate Bill
164.

Sincerely,
Harry Hughes
Governor
