(House Bill 778)

AN ACT concerning

Elderly Persons — Employment

FOR the purpose of requiring the Director on Aging, in
consultation with the Secretary of Personnel, to
develop a 3-year demonstration program for employing
persons who have reached a certain age in State
agencies; exempting certain persons from the
requirement that they join the State Employees'
Retirement System; and requiring certain officials to
report the results of the demonstration program to the

General Assembly prior to a certain date;__and

prohibiting retired members of state retirement systems
from participating in this program.

BY adding to

Article 70B — Office on Aging
Section 4(d)

Annotated Code of Maryland
(1978 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section (s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 70B — Office on Aging

4.

(D) (1) IN CONSULTATION WITH THE SECRETARY OF
PERSONNEL, THE DIRECTOR ON AGING SHALL ESTABLISH A 3-YEAR
DEMONSTRATION EMPLOYMENT PROGRAM FOR PERSONS 70 YEARS OF AGE
AND OVER TO DETERMINE THE FEASIBILITY OF FINDING EMPLOYMENT
FOR THOSE PERSONS IN STATE AGENCIES.

(2)   THE PERSONS EMPLOYED IN THE DEMONSTRATION

PROGRAM MAY NOT BE REQUIRED TO SHALL BE HIRED UNDER THE

PROVISIONS OF ARTICLE 64A BUT SHALL NOT BECOME MEMBERS OF

THE STATE, EMPLOYEES' RETIREMENT SYSTEM.

(3)   THE DIRECTOR ON AGING AND THE SECRETARY OF
PERSONNEL SHALL SUBMIT A REPORT TO THE GENERAL ASSEMBLY NO
LATER THAN THE SECOND WEDNESDAY OF JANUARY, 1981 1982,
CONCERNING THE FEASIBILITY AND PRODUCTIVITY OF EMPLOYING
ELDERLY PERSONS IN STATE AGENCIES.

(4) THE PROVISIONS OF THIS SECTION SHALL__REMAIN

UNTIL JUNE 30,1982, AFTER WHICH DATE, WITHOUT FURTHER

ACTION BY THE GENERAL ASSEMBLY, THIS SECTION SHALL__HAVE__NO

FORCE OR EFFECT.

(5) NO RETIRED MEMBER OF A STATE RETIREMENT SYSTEM

SHALL BE EMPLOYED IN THIS DEMONSTRATION PROGRAM.
