(C) DURING THE DATES THAT THE MARYLAND STATE FAIR IS

IN OPERATION AT THE TIMONIUM FAIR GROUNDS, THE RACETRACK AT

THE TIMONIUM FAIR GROUNDS SHALL BE EXEMPT FROM PAYMENT OF

THE TAX AT THE RATE OF 5.34 PERCENT ON THE TOTAL AMOUNT OF

MONEY WAGERED ON ALL RACES AS LEVIED IN (A) OF THIS

SUBSECTION.

(D) NOTWITHSTANDING THE REQUIREMENTS OF SUBSECTION (A)
OF THIS SECTION, THE STATE TAX OF 5.50 PERCENT IS NOT
PAYABLE BY THE MARYLAND STATE FAIR AND AGRICULTURAL SOCIETY,

INCORPORATED FOR DAYS OF RACING BEING RUN BY THE SOCIETY__AT

THE TIMONIUM TRACK ON ANY DATES WHEN THE MARYLAND STATE FAIR

IS BEING CONDUCTED. ON THESE DATES ALL OF THE OTHER

PROVISIONS OF THIS SECTION ARE APPLICABLE, EXCEPT AS

PROVIDED IN THIS SUBSECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning

Racing Commission - Distribution of Pool Receipts

FOR the purpose of changing the distribution of breakage and
percentages of certain mutuel pools on races conducted
in Maryland under the authority of the Maryland Racing
Commission; providing for the allocation of certain
percentages of certain mutuel pools to the Maryland
Race Track Employees Pension Fund; specifying the

purposes for which an additional allocation of moneys

at mile tracks may be used by the licensee; providing
for limitations on contributions by track licensees;
clarifying language; and generally relating to the
Maryland Racing Commission.
