(1975 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 78B — Racing Commission

(E) (1) IN ADDITION TO ANY OTHER MONEYS RETAINED BY

THE LICENSEE UNDER THE PROVISIONS OF THIS SECTION, THE

HARNESS RACING BOARD MAY AUTHORIZE ANY LICENSEE, WHOSE

HARNESS RACETRACK IS LOCATED IN A COUNTY WITH A POPULATION

DENSITY UNDER 100 PER SQUARE MILE AS DETERMINED BY THE

DEPARTMENT OF HEALTH AND MENTAL HYGIENE, TO RETAIN AN

ADDITIONAL 1 PERCENT OF THE TWO HORSE MULTIPLE-----MUTUEL POOL

AND THE THREE OR MORE HORSE MULTIPLE MUTUEL POOL OF ALL

MONEY WAGERED TO BE USED EXCLUSIVELY FOR CAPITAL

IMPROVEMENTS TO THE RACETRACK.

    (2) THE PROVISIONS OF THIS SUBSECTION SHALL APPLY

FOR A PERIOD OF 3 YEARS BEGINNING JULY 1, 1979.

(3) THE LICENSEE SHALL REPORT AS FREQUENTLY AS

THE BOARD SHALL REQUIRE ON ALL MONEYS RETAINED BY THE

LICENSEE UNDER THE PROVISIONS OF THIS SUBSECTION AND THE

LICENSEE MAY NOT EXPEND ANY OF THESE MONEYS WITHOUT THE

APPROVAL OF THE BOARD.

(4) MONEYS PERMITTED TO BE RETAINED BY THE

LICENSEE UNDER THE PROVISIONS OF THIS SUBSECTIONS SHALL BE

USED EXCLUSIVELY FOR CAPITAL IMPROVEMENTS TO OR UPON THE

PROPERTY OWNED OR LEASED BY THE LICENSEE AND USED BY IT FOR

RACING.

(5) ALL CAPITAL IMPROVEMENTS PROPOSED TO BE MADE
BY THE LICENSEE UNDER THE PROVISIONS OF THIS SUBSECTION

SHALL BE SUBJECT TO THE APPROVAL OF THE BOARD PROVIDED THAT

THE CAPITAL IMPROVEMENTS WILL PROMOTE THE SAFETY,

CONVENIENCE AND COMFORT OF THE RACING PUBLIC AND HORSE

OWNERS AND GENERALLY IMPROVE RACING IN THE STATE.
