The Public Local Laws of Frederick County

Section 9-1, 9-2, and 9-3

Article 11 - Public Local Laws of Maryland

(1959 Edition, as Supplemented through December 1975,
as amended by Chapter 105 of the Acts of 1976
and Chapter 736 of the Acts of 1978.)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 9-1 and 9-2, inclusive, of the
Public Local Laws of Frederick County being Article 11 of
the Code of Public Local Laws of Maryland be repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Code of Public Local Laws of Maryland be repealed,
amended, or enacted to read as follows:

Article 11 - Frederick County

9-1.

IT SHALL BE UNLAWFUL FOR ANY PERSONS OR ASSOCIATION TO
PROVIDE FIRE PROTECTION OR FIRE FIGHTING SERVICE OR RESCUE
SERVICE IN FREDERICK COUNTY UNLESS A VOLUNTEER FIRE
DEPARTMENT IS INCORPORATED, DESIGNATED AND APPROVED AND
RECOGNIZED BY THE FREDERICK COUNTY FIREMEN'S ASSOCIATION AND
THE BOARD OF COUNTY COMMISSIONERS OF FREDERICK COUNTY. ANY
PERSON, PERSONS OR ORGANIZATIONS CONVICTED OF VIOLATING THIS
SECTION SHALL BE SUBJECT TO A FINE NOT TO EXCEED $1,000 FOR
EACH OFFENSE OR IMPRISONMENT FOR A TERM NOT EXCEEDING 6
MONTHS, OR BOTH FINE AND IMPRISONMENT IN THE DISCRETION OF
THE COURT. IN ADDITION, ANY PERSON, PERSONS OR ASSOCIATION
VIOLATING THIS SECTION SHALL BE SUBJECT TO BEING ENJOINED
FROM VIOLATING THIS SECTION, AND IN ADDITION, A CIVIL
PENALTY MAY BE RECOVERED BY THE BOARD OF COUNTY
COMMISSIONERS IN THE AMOUNT OF $2,000 EACH FOR EACH OFFENSE
FROM ANY PERSON OR PERSONS VIOLATING THIS SECTION. THIS
SECTION IS NOT INTENDED TO INCLUDE PRIVATE PROPERTY AND
GOVERNMENT INSTALLATIONS.

THE BOARD OF COUNTY COMMISSIONERS WITH THE ADVICE OF
THE FREDERICK COUNTY FIREMEN'S ASSOCIATION MAY, BY RULES AND
REGULATIONS ADOPTED BY THE BOARD OF COUNTY COMMISSIONERS,
PROVIDE SPECIFICATIONS FOR EQUIPMENT, SERVICE AREA
DESIGNATIONS AND OPERATIONS IN THE BEST INTEREST OF FOR THE
VOLUNTEER FIRE DEPARTMENTS IN FREDERICK COUNTY, AND IN
ADDITION, ANY VOLUNTEER FIRE DEPARTMENT WHICH IS
INCORPORATED AND APPROVED AND RECOGNIZED BY THE FREDERICK
