(3) IF THE CAMPAIGN EXPENDITURES OF ANY
CANDIDATE OR NOMINEE EXCEEDS THE SUM PERMITTED UNDER
PARAGRAPH (1) OF THIS SUBSECTION, THAT CANDIDATE OR NOMINEE
SHALL FORFEIT ANY OFFICE ON THE BOARD TO WHICH HE WAS
ELECTED.

(C) THE BOARD OF SUPERVISORS OF ELECTIONS OF GARRETT
COUNTY SHALL PROVIDE FOR THE ELECTION OF MEMBERS OF THE
BOARD OF EDUCATION. A VOTER MAY VOTE FOR ONLY ONE NOMINEE
IN EACH DISTRICT AND ONLY TWO NOMINEES IN THE AT-LARGE
CATEGORY. PROVISIONS SHALL BE MADE FOR USE OF VOTING
MACHINES, OR FOR THE USE OF PAPER BALLOTS UNDER THE
CONDITIONS PRESCRIBED IN THIS SUBSECTION. THE NAMES OF ALL
CANDIDATES WHO HAVE BEEN DULY NOMINATED UNDER THE PROVISIONS
OF SUBSECTION (A) OF THIS SECTION FOR ELECTION TO THE
SEVERAL BOARD OF EDUCATION OFFICES SHALL, EXCEPT IN THE CASE
OF DEATH, BE PLACED ON THE BALLOT. THE BOARD OF SUPERVISORS
OF ELECTIONS SHALL PROVIDE THE MEANS FOR ALL REGISTERED
VOTERS OF GARRETT COUNTY, IRRESPECTIVE OF PARTY AFFILIATION
TO VOTE FOR THE NOMINEES FOR THE BOARD IN THE PRIMARY
ELECTION OR FOR THE CANDIDATES FOR THE BOARD IN THE GENERAL
ELECTION. THE CANDIDATE FROM EACH OF THE THREE COUNTY
COMMISSIONER DISTRICTS WHO RECEIVES THE GREATEST NUMBER OF
VOTES CAST COUNTYWIDE SHALL BE DECLARED ELECTED TO THE BOARD
FROM THAT COUNTY COMMISSIONER DISTRICT. THE TWO CANDIDATES
WHO RECEIVE THE GREATEST NUMBER OF VOTES OF ANY CANDIDATE
SEEKING ELECTION AT LARGE SHALL BE DECLARED ELECTED TO THE
BOARD. ALL VOTING FOR THE BOARD MEMBERS, EITHER IN A
PRIMARY ELECTION 08 IN A GENERAL ELECTION, SHALL BE
CONDUCTED ON A NONPARTISAN BASIS. NO DESIGNATION OF PARTY
AFFILIATION MAY BE PLACED UPON ANY PETITION FOR NOMINATION,
NOR UPON ANY VOTING MACHINE OR PAPER BALLOT USED AT ANY
PRIMARY OR GENERAL ELECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That the
incumbent members of the Garrett County Board who hold
office on July 1, 1981 shall hold office until their
successors are elected and qualify as follows:

(1)   Three members of the County Board shall be
elected from the County Commissioner Districts in the
November general election of 1982 and every 4 years after to
replace the three interim incumbent members of the Board
whose terms expire in 1983, 1984, and 1985; and

(2)   Two members of the County Board shall be
elected from the county at large in the November general
election of 1984 and every 4 years after to replace the two
interim incumbent members of the Board whose terms expire in
1986 and 1987.

SECTION 3. AND BE IT FURTHER ENACTED, That before this
Act becomes effective it shall first be submitted to a
referendum of the legally qualified voters of Garrett County
at a special election to be held at the same time as the
