Article 78A - Public Works
25G.

(A)  (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)   "BUILDING" MEANS THE ROOF, WALLS, AND
PROJECTIONS CONSTITUTING A CONTROLLED ENVIRONMENTAL AREA AND
THE ENERGY SYSTEMS THAT CREATE THE CONTROLLED ENVIRONMENT.

(3)   "ENERGY AUDIT" MEANS AN IN DEPTH ENGINEERING
ANALYSIS OF THE FACTORS CAUSING ENERGY WASTE IN A BUILDING
THAT INVESTIGATES THE AMOUNT AND COST OF ENERGY WASTE AND
THAT COMPARES THE ENERGY WASTE COST WITH THE EXPENSE OF
REMEDYING THE ENERGY WASTE ON A COST-EFFECTIVE BASIS.

(4)   "ENERGY USE" MEANS THE ENERGY CONSUMED IN
ENERGY SYSTEMS THAT INCLUDE, BUT ARE NOT LIMITED TO:

(I)   ANY EQUIPMENT THAT IS EMPLOYED TO HEAT
A BUILDING;

(II)   ANY EQUIPMENT THAT IS EMPLOYED TO
COOL A BUILDING;

(III)   ANY EQUIPMENT THAT IS EMPLOYED TO
HEAT WATER USED IN A BUILDING;

(IV)   ANY EQUIPMENT ON THE SITE THAT IS
EMPLOYED TO GENERATE ELECTRICITY FOR THE BUILDING; AND

(V)   ANY EQUIPMENT THAT IS EMPLOYED ON THE
SITE TO USE THE SUN, WIND, OIL, NATURAL GAS, COAL, AND
ELECTRICITY AS ITS POWER SUPPLY IN WHOLE OR IN PART.

(5)   "THERMAL PERFORMANCE" MEANS THE BEHAVIOR OF
A BUILDING IN REGARD TO LIMITING HEAT TRANSFER TO THE
OUTSIDE ENVIRONMENT.

(B)   THE DEPARTMENT OF GENERAL SERVICES SHALL CONDUCT
AN ENERGY AUDIT FOR THE HERBERT R. O'CONNOR STATE OFFICE
COMPLEX IN BALTIMORE CITY AND THE MILLARD TAWES STATE OFFICE
COMPLEX IN ANNAPOLIS. THE DEPARTMENT SHALL CONTRACT WITH A
PROFESSIONAL CONSULTING FIRM TO PERFORM THE ENERGY AUDITS.

(C)   THE PURPOSE OF THE ENERGY AUDITS IS:

(1) TO IDENTIFY:

(I)   OUTMODED EQUIPMENT,

(II)   DETERIORATING ENERGY SYSTEMS,

(III) MALFUNCTIONING COMPONENTS,
