(House Bill 1113)
AN ACT concerning

Controlled Dangerous Substance — Delivery to Prisoners

FOR the purpose of changing the reference to the definition
of drugs as used in the laws prohibiting the delivery
of drugs to prisoners, in order that they pertain to
controlled dangerous substances; and clarifying
language.

BY repealing and reenacting, with amendments,

Article 27 — Crimes and Punishments

Section 122A and 122A-1

Annotated Code of Maryland

(1976 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 — Crimes and Punishments

122A.

Whoever delivers or procures to be delivered, or has in
his possession with intent to deliver, to a person legally
detained and confined in any penal institution, reformatory
or other place of confinement within the State, or whoever
deposits or conceals in or about the institution, or upon
any land appurtenant thereto, anything to effect the escape
of a prisoner or inmate lawfully detained therein, any

intoxicating beverage, or any stimulating, sedative, or

narcotic—drug, or dangerous drug as defined in § [307]

277(F) of this article CONTROLLED DANGEROUS SUBSTANCE AS
DEFINED IN 5 277(F) OF THIS ARTICLE, except upon written
prescription of the regularly appointed physician thereof,
with the intent that a convict shall obtain or receive it,
and whoever receives from a convict anything to effect the
escape of a prisoner or inmate lawfully detained therein,
any intoxicating beverage, or any stimulating, sedative, or
narcotic drug, or dangerous drug as defined in § [307]
277(F) of this article
CONTROLLED DANGEROUS SUBSTANCE AS
DEFINED IN § 277(F) OF THIS ARTICLE with the intent to
convey it out of the institution without written permission
of the superintendent of prisons or the officer in charge of
said penal institution or place of confinement, shall be
guilty of a misdemeanor and shall be punished by
