(House Bill 986)

AN ACT concerning

Burglary — Breaking and Entering

FOR the purpose of making it a criminal offense to break
into certain places of another, other than to benefit
the owner or lawful occupant
; and providing penalties.

BY adding to

Article 27 — Crimes and Punishments

Section 31B

Annotated Code of Maryland

(1976 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 27 - Crimes and Punishments

31B.

ANY PERSON WHO BREAKS AND ENTERS A STOREHOUSE, SHOP,
STOREROOM, FILLING STATION, GARAGE, TRAILER, CABINET CABIN,
DINER, BOAT, TOBACCO HOUSE, WAREHOUSE, OR OTHER OUTHOUSE OF
ANOTHER IN THE DAY OR NIGHT, OTHER THAN FOR THE PURPOSE OF
BENEFITING THE OWNER OR LAWFUL OCCUPANT,
SHALL BE GUILTY OF
A MISDEMEANOR AND, UPON CONVICTION, SHALL BE SENTENCED TO
IMPRISONMENT FOR NOT MORE THAN 18 6 MONTHS OR A FINE OF NOT
MORE THAN $500, OR BOTH.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
