Chapter 823 in the referendum which was held in November,
1978; this Act is intended to codify in the Education
Article those provisions; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Chapter 823 of the Acts of the General
Assembly of 1977 be repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Article — Education

3—113.

(a) Elected county boards.

In the following counties, the members of the county
board shall be elected:

(1)   Allegany;

(2)   Carroll;

(3)   Charles;

(4)   Howard;

(5)   Kent;

(6)   Prince George's;

(7)   Montgomery; [and]

(8)   SOMERSET; AND

[(8)] (9) Washington.

SUBTITLE 9. SOMERSET COUNTY.
3-901.

(A)   THE SOMERSET COUNTY BOARD CONSISTS OF:

(1)   ONE MEMBER FROM EACH COUNCILMANIC
COMMISSIONER DISTRICT IN THE COUNTY; AND

(2)   ONE MEMBER FROM THE COUNTY AT LARGE.

(B)  (1) A MEMBER FROM A COUNCILMANIC COMMISSIONER
DISTRICT SHALL BE A RESIDENT OF THAT DISTRICT.

(2) THE MEMBER FROM THE COUNTY AT LARGE SHALL BE
A RESIDENT OF THE COUNTY.
