Ch. 551

subdivision of the State, or any sheriff or deputy sheriff,
who is killed in the performance of duties. The amount of
the benefit shall be $25,000, less ANY AMOUNT RECEIVED BY
THAT PERSON FROM:

(i) Any lump sum death benefit payable by
the State or any political subdivision, exclusive of any
return of contributions, or,

(ii) The present value of any benefit
payable under the provisions of Article 73B, § 11 (11) (b)
of the Code.

(2) This sum shall be in addition to any:

(I)   [workmen's] WORKMEN'S compensation
benefits[.]; OR

(II)   PROCEEDS OF ANY FORM OF LIFE
INSURANCE, REGARDLESS OF WHO PAID THE PREMIUMS ON THE
INSURANCE.

(c) In the event there is [neither] NO surviving
spouse [nor], children, OR DESIGNATED BENEFICIARY, payment
shall be made to the estate.

SECTION 2., AND BE IT FURTHER ENACTED, That this Act
shall apply to any law enforcement officer killed in the
line of duty on or after January 1, 1978.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
