Ch. 538

[(b) All licenses shall be renewed annually by
application to the Board, upon payment of a renewal fee
established by the Board and the renewal of license shall be
granted unless the licensee improperly or unlawfully
obtained the license in the first instance or since its
issuance has committed a substantial violation of any
provision of this subtitle. Any licensee who fails to make
application for renewal of his or her license within three
months of its expiration, accompanied by the required
renewal fee, shall be refused a renewal until he or she
shall have successfully passed the examination as set forth
in § 607 of this subtitle and paid the fee established by
the Board for the examination. However, a physical
therapist or physical therapist assistant who took the
licensing examination of the professional examination
service and whose license lapsed for a period not exceeding
three years during which the licensee did not actively
practice as a physical therapist or physical therapist
assistant is not required to repeat the licensing
examination, but shall be required to file a new application
with the required application fee. ]

(A)    A LICENSE ISSUED UNDER THIS SUBTITLE EXPIRES ON
DECEMBER 31 OF EACH YEAR, UNLESS IT IS RENEWED FOR A
SUBSEQUENT 1-YEAR TERM AS PROVIDED IN THIS SECTION.

(B)    A LICENSEE PERIODICALLY MAY RENEW HIS LICENSE
BEFORE IT EXPIRES IF THE LICENSEE:

(1)    SUBMITS TO THE BOARD:

(I)    A RENEWAL APPLICATION ON THE FORM
THAT THE BOARD REQUIRES; AND

(II)   THE RENEWAL FEE THAT THE BOARD SETS;
AND

(2)    OTHERWISE IS ENTITLED UNDER THE SUBTITLE TO
CONTINUED LICENSURE.

(C)    (1) AN INDIVIDUAL WHO WAS LICENSED ON THE BASIS
OF PASSING AN EXAMINATION THAT THE PROFESSIONAL EXAMINATION
BOARD PROVIDED MAY RENEW HIS LICENSE WITHIN A 3-YEAR PERIOD
AFTER IT HAS EXPIRED IF THE INDIVIDUAL:

(I)    HAS NOT ENGAGED IN ACTIVE PRACTICE AS
A PHYSICAL THERAPIST OR PHYSICAL THERAPIST ASSISTANT IN THE
STATE DURING THE 3-YEAR PERIOD;

(II)   HAS NOT VIOLATED ANY OTHER PROVISION
OF THIS SUBTITLE; AND

(III) SUBMITS TO THE BOARD A NEW
APPLICATION AND THE APPLICATION FEE THAT THE BOARD SETS.
