BEFORE COMMENCING OFFICIAL DUTIES, EACH OFFICER
APPOINTED UNDER THIS SUBHEADING SHALL TAKE AN OATH OF OFFICE
ADMINISTERED BY THE CLERK OF THE COURT IN THE JURISDICTION
WHERE THE COMMISSION IS RECEIVED.

(A)   MEMBERS OF THE MARYLAND RAILROAD POLICE SHALL HAVE
ALL THE POWERS GRANTED A PEACE OR POLICE OFFICER.

(B)   A MARYLAND RAILROAD POLICE OFFICER MAY NOT
EXERCISE THE POWERS GRANTED IN SUBSECTION (A) OF THIS
SECTION UNLESS THE OFFICER:

(1)   IS ON REAL OR PERSONAL PROPERTY OWNED,
LEASED, OPERATED, OR CONTROLLED BY AN EMPLOYING RAILROAD,
HEREINAFTER REFERRED TO AS RAILROAD PROPERTY;

(2)   IS ENGAGED IN FRESH PURSUIT OF A SUSPECTED
OFFENDER;

(3)   IS REQUESTED OR AUTHORIZED TO ACT BY THE
EXECUTIVE OFFICER OR CHIEF POLICE OFFICER OF ANY COUNTY OR
BALTIMORE CITY;

(4) IS IN SEARCH OF AN OFFENDER WANTED FOR A

CRIME ALLEGEDLY COMMITTED ON RAILROAD PROPERTY OR IS SEEKING
TO INTERVIEW A WITNESS TO A CRIME;

(5)---DETERMINES ACTION IS NECESSARY TO FACILITATE

THE ORDERLY FLOW OF TRAFFIC TO, FROM, OR AROUND RAILROAD

PROPERTY; OR

(6) (4) IS ORDERED TO ACT BY THE GOVERNOR.

(C)   A RAILROAD EMPLOYING A MARYLAND RAILROAD POLICE
OFFICER IS LIABLE FOR ANY WRONGFUL ACTIONS OR ABUSE OF POWER
BY THE OFFICER.

ANY PERSON HAVING CHARGE OF A JAIL OR OTHER PLACE OF
DETENTION SHALL, UNLESS SUFFICIENT FACILITIES ARE NOT
AVAILABLE, RECEIVE AND CONFINE ANY PERSON ARRESTED BY A
POLICE OFFICER OF A RAILROAD. SUCH PERSON SHALL BE DEEMED
TO BE IN CUSTODY OF THE RAILROAD POLICE, AND SUCH PERSON
SHALL HAVE THE SAME STATUS AS PERSONS ARRESTED BY ANY OTHER

POLICE OR PEACE OFFICER OF THIS STATE. ANY PERSON SO

CONFINED SHALL BE RELEASED ONLY TO AND UPON WRITTEN ORDER OF
PROPER AUTHORITY.
