BY repealing and reenacting, with amendments,

Article 2B — Alcoholic Beverages
Section 86(h) and 102
Annotated Code of Maryland
(1976 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

86.

(h) In Montgomery County no person shall consume any
alcoholic beverages on any premises open to the general
public, or any place of public entertainment, which holds a
Class B, Class C, Class D or Class H beer license; or a
Class B, Class C, Class D or Class H beer and light wine
license; or a Class B beer, wine and liquor license, nor
shall any owner, operator or manager of said premises or
place knowingly permit such consumption of alcoholic
beverages between 1:30 o'clock a.m. and the next succeeding
hour authorized by law for sales to begin under the
respective licenses. All containers of alcoholic beverages
shall be removed from the table or tables prior to
1:30 o'clock a.m., EXCEPT ON FRIDAYS AND SATURDAYS WHEN ALL

CONTAINERS OF ALCOHOLIC BEVERAGES SHALL BE REMOVED PRIOR__TO

2:30 A.M.

102.

(a) In Montgomery County, notwithstanding any other
provisions of this subtitle, a holder of an alcoholic
beverage license may not sell any alcoholic beverages
between the hours of [1:00 o'clock] 1 a.m. and 12 [
o'clock] noon on Sunday, except holders of Class A
(off—sale) beer licenses and Class A (off-sale) beer and
light wine licenses and Class B, CLASS BE, CLASS B-BWL
(H—M) and Class C, beer, wine and liquor licenses; Class B

     (R) (5) IN MONTGOMERY COUNTY THERE IS, IN ADDITION

TO THE OTHER CLASSES PROVIDED FOR, A SPECIAL CLASS B LICENSE

KNOWN AS CLASS BE. ALL OF THE PRIVILEGES AND RESTRICTIONS,

APPLY TO A CLASS BE LICENSE. THE ANNUAL LICENSE FEE FOR A

CLASS BE LICENSE IS $500 MORE THAN THE FEE FOR A CLASS B

LICENSE.
