in this State for compliance with the rules and regulations
established by the Board. Any part of a building that
contains part of a licensed hospital or related institution
and any surrounding outbuilding is considered part of the
facility and is subject to inspection to determine occupancy
status for licensure purposes. The inspections shall take
place on an unannounced basis at least twice a year. The
findings of the inspections, whether carried out on an
announced or unannounced basis, shall be reported to the
General Assembly during its annual session.
(2) ANY EMPLOYEE OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE WHO INFORMS ANY HOSPITAL OR RELATED
INSTITUTION OF ANY ANTICIPATED INSPECTION ACTIVITY, UNLESS
DIRECTED TO DO SO BY THE CHIEF OF THE DIVISION, IS GUILTY OF
A MISDEMEANOR AND SHALL BE FINED$1,000, IMPRISONED FOR 1
YEAR, OR BOTH. , UPON CONVICTION, SHALL BE SENTENCED TO
IMPRISONMENT FOR NOT MORE THAN 1 YEAR OR A FINE OF NOT MORE
THAN $1,000, OR BOTH.
(3) ANY EMPLOYEE OR OWNER OF A HOSPITAL OR
RELATED INSTITUTION THAT ACCEPTS INFORMATION ABOUT
ANTICIPATED INSPECTION ACTIVITIES WITHOUT NOTIFYING THE
DEPARTMENT OR THE ATTORNEY GENERAL IMMEDIATELY THEREAFTER IS
GUILTY OF A MISDEMEANOR AND SHALL BE FINED $1,000, OR
IMPRISONED FOR 1 YEAR, OR BOTH.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

AN ACT concerning
Program Open Space
FOR the purpose of requiring the use of past and future
allocations from the federal Land and Water
Conservation Fund to the Department of Natural
Resources for certain Program Open Space purposes of
the Department and of other governmental entities; and
requiring an annual report to the Legislature.
