Ch. 370

813B.

(A)  THE GOVERNOR SHALL APPOINT AND MAINTAIN A COUNCIL
ON TOXIC SUBSTANCES WHICH SHALL ADVISE THE SECRETARY IN ALL
MATTERS CONCERNING TOXIC AND CARCINOGENIC SUBSTANCES. THE
MEMBERS OF THE COUNCIL SHALL BE APPOINTED FROM A LIST OF
PERSONS RECOMMENDED BY THE SECRETARY. IN ADDITION TO THOSE
MEMBERS APPOINTED BY THE GOVERNOR, THE COUNCIL SHALL HAVE
ONE MEMBER FROM THE SENATE OF MARYLAND, APPOINTED BY THE
PRESIDENT OF THE SENATE, AND ONE MEMBER FROM THE HOUSE OF
DELEGATES, APPOINTED BY THE SPEAKER OF THE HOUSE.

(B)  THE COUNCIL SHALL BE COMPRISED OF REPRESENTATIVES
FROM THE DEPARTMENTS OF HEALTH AND MENTAL HYGIENE, NATURAL
RESOURCES, AGRICULTURE, LICENSING AND REGULATION,
TRANSPORTATION, STATE PLANNING, AND COMMUNITY AND ECONOMIC
AND COMMUNITY DEVELOPMENT, THE STATE FIRE MARSHAL, THE STATE
POLICE, THE MARYLAND CIVIL DEFENSE AND EMERGENCY
PREPAREDNESS AGENCY, THE AFL-CIO, THE MARYLAND CHAMBER OF
COMMERCE, THE JOHNS HOPKINS AND UNIVERSITY OF MARYLAND
MEDICAL INSTITUTIONS, AND ANY OTHER PRIVATE OR GOVERNMENTAL
ENTITY THAT THE GOVERNOR DEEMS APPROPRIATE. EACH PERSON
APPOINTED TO THE COUNCIL SHALL BE KNOWLEDGEABLE CONCERNING
OR HAVE A SERIOUS INTEREST IN TOXIC AND CARCINOGENIC
SUBSTANCES. THERE SHALL BE NO MORE THAN 25 PERSONS ON THE
COUNCIL AND MEMBERS OF THE COUNCIL SHALL SERVE AT THE
PLEASURE OF THE GOVERNOR THE COUNCIL SHALL CONSIST OF 25
MEMBERS APPOINTED FOR 3-YEAR TERMS AND BE ELIGIBLE FOR
REAPPOINTMENT.

(C) THE FIRST APPOINTEES TO THE COUNCIL UNDER THIS
SUBTITLE SHALL BE THOSE PERSONS SERVING ON THE COUNCIL AS OF
JULY 1, 1979.

(D) (C) THE MEMBERS OF THE COUNCIL SHALL RECEIVE NO
COMPENSATION FOR THEIR SERVICES AS MEMBERS, BUT SHALL BE
REIMBURSED FOR ACTUAL EXPENSES INCURRED IN THE PERFORMANCE
OF THEIR DUTIES UNDER THIS SUBTITLE AS PROVIDED IN THE
ANNUAL STATE BUDGET. NECESSARY SECRETARIAL AND SUPPORT
SERVICES SHALL BE PROVIDED BY THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE.

(E) (D) THE MEMBERS OF THE COUNCIL SHALL DETERMINE THE
TIME, PLACE, AND FREQUENCY OF MEETINGS AND DESIGNATE A
CHAIRPERSON FOR THE COUNCIL.

813C.

(A) THE COUNCIL SHALL MAY:

(1)  COLLECT AND EVALUATE ALL PERTINENT AVAILABLE
DATA ON TOXIC AND CARCINOGENIC SUBSTANCES INCLUDING ASBESTOS
IN SCHOOLS AND PUBLIC BUILDINGS;

(2)  ADVISE THE SECRETARY ON SHORT-RANGE AND
LONG-RANGE COURSES OF ACTION IN DEALING WITH THOSE
SUBSTANCES;
