held not later than one month prior to June first in each
year in which a vacancy occurs, appoint as a member of the
commission a citizen of the county for which the district is
created, for a term of six years, to succeed the member
whose term expires on the June first next succeeding.
At the expiration of the term of each of the
three members serving on the commission prior to June 1,
1963, the said governing body shall, at a meeting held not
later than one month prior to January first in each year in
which such a vacancy occurs, appoint as a member of the
commission a citizen of the county for which the district is
created, for a term of six years and five months, to succeed
the member whose term expires on the January first next
succeeding. Thereafter, each appointment made to said
commission shall, at a meeting held not later than one month
prior to June first in each year in which a vacancy occurs,
be made by said governing body for a term of six years from
June first next succeeding.
The sole purpose of this section is to enlarge
the membership of the existing commission to seven members
to more effectively carry out the provisions of this
subtitle, and neither this section or the action of said
governing body in appointing four additional members
provided for herein shall be construed to alter, abrogate,
change or affect in any way any contract, agreement,
obligation, commitment or undertaking to which the
commission is now a party, or in which the commission is
presently engaged.
(2-3) (I) THE DORCHESTER COUNTY AND KENT COUNTY
SANITARY COMMISSION COMMISSIONS APPOINTED PURSUANT TO
PARAGRAPH (1) OF THIS SUBSECTION MAY BE ENLARGED FROM THREE
CITIZENS OF THE RESPECTIVE COUNTY TO FIVE CITIZENS OF THE
RESPECTIVE COUNTY, NO ONE OF WHOM SHALL HOLD ANY OTHER
OFFICE OF IN THE RESPECTIVE COUNTY DURING HIS TERM OF OFFICE
ON THE COMMISSION. AS OF JULY 1, 1979, THE GOVERNING BODY
BODIES OF DORCHESTER COUNTY AND KENT COUNTIES MAY APPOINT
THE TWO ADDITIONAL MEMBERS OF THE COMMISSION PROVIDED FOR IN
THIS PARAGRAPH, WHOSE TERMS OF OFFICE SHALL COMMENCE ON THE
DATE OF APPOINTMENT, ONE OF WHOM SHALL SERVE 4 YEARS AND ONE
FOR 2 YEARS. AT THE EXPIRATION OF EACH OF THE TERMS, THE
RESPECTIVE COUNTY GOVERNING BODY SHALL, AT A MEETING HELD
NOT LATER THAN 1 MONTH PRIOR TO JULY FIRST IN EACH YEAR IN
WHICH A VACANCY OCCURS, APPOINT AS A MEMBER OF THE
COMMISSION A CITIZEN OF THE RESPECTIVE COUNTY FOR WHICH THE
DISTRICT IS CREATED, FOR A TERM OF 6 YEARS, TO SUCCEED THE
MEMBER WHOSE TERM EXPIRES ON JULY FIRST NEXT SUCCEEDING.
(II) THERE SHALL BE NO ALTERATION IN THE
EXISTING METHOD OF APPOINTMENTS AT THE EXPIRATION OF THE
EXISTING COMMISSION COMMISSIONS IN DORCHESTER COUNTY AND
KENT COUNTY.
