(House Bill 344)

AN ACT concerning

Nursing Facilities - Absences

FOR the purpose of specifying, for purposes of medical
assistance payments to nursing facilities, a maximum
period of absence for hospital stays; and deleting
certain references to federal criteria.

BY repealing and reenacting, with amendments,

Article 43 - Health

Section 566B(c)

Annotated Code of Maryland

(1971 Replacement Volume and 1978 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

566B.

(c) Payments under paragraph (1) of subsection (b) of
this section shall be made for [the maximum periods allowed
under rules and regulations of the United States Department
of Health, Education and Welfare] A MAXIMUM OF 15 DAYS FOR
ANY SINGLE HOSPITAL STAY. Payments under paragraph (2) of
subsection (b) shall be made for a maximum aggregate of 18
days in any calendar year. Notwithstanding any regulation
to the contrary, a leave of absence is not subject to any
requirement that it must not exceed a particular number of
days per visit, except that the leave of absence may not
exceed a total of 18 days during any 12-month period.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.
