Preamble
WHEREAS, The financial administration function in the
State is carried out principally by the Comptroller, the
Treasurer, and the Secretary of Budget and Fiscal Planning.
Today's government organization does not recognize a
"finance department," although Article 41 establishes a
finance department and places it under dual heads, the
Comptroller and the Treasurer- Further provisions then
describe three "divisions" of the department which include
the organization supervised by the Comptroller (referenced
in this section as the "Division of Financial Review and
Control") , the organization supervised by the Treasurer
(referenced in this section as the "Division of Deposit and
Disbursement"), and the Board of Public Works. Because
today's executive branch organization does not include an
agency wherein the three divisions report to one director
(other than as the Governor may be considered their
director), those provisions may-be repealed; now, therefore,
SECTION 1- BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

The Finance Department is hereby established. It
shall comprise the Treasury Department, as created by the
Constitution, and perform such additional functions as are
herein prescribed. The heads of this Department shall be
the Comptroller and the Treasurer, exercising, respectively,
the rights, powers, duties, obligations and functions now or
herein or hereafter conferred upon him, respectively, by the
Constitution and laws of the State.]
