(3) THE FOLLOWING INDIVIDUALS MAY NOT BE
APPOINTED TO THE BOARD:

(I) ANY INDIVIDUAL WHO IS SUBJECT TO THE
AUTHORITY OF THE BOARD;

(II) THE GOVERNOR; AND

(III) THE STATE SUPERINTENDENT.

(C) TERM; VACANCIES.

(1)   EACH MEMBER SERVES FOR A TERM OF 5 YEARS AND
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES. THESE TERMS
ARE STAGGERED AS REQUIRED BY THE TERMS OF THE MEMBERS
SERVING ON THE STATE BOARD AS OF JULY 1, 1978.

(2)   THE SEVEN MEMBERS SERVING ON THE STATE BOARD
AS OF JUNE 30, 1976 ARE:

(I)   MEMBERS OF THE BOARD FOR THE REMAINDER OF
THEIR TERMS; AND

(II)    ELIGIBLE FOR REAPPOINTMENT TO THE SAME
EXTENT AS ON JUNE 30, 1976.

(3)   THE GOVERNOR SHALL APPOINT A NEW MEMBER TO
FILL ANY VACANCY ON THE BOARD FOR THE REMAINDER OF THAT TERM
AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)         A MEMBER IS ELIGIBLE FOR REAPPOINTMENT BUT

MAY NOT SERVE FOR MORE THAN TWO FULL 5-YEAR TERMS.

REVISOR'S NOTE: This section presently appears as Art.
77, §3(a), (b), (c), and (e).

The last sentence of present Art. 77, §3(c),
which deals with appointments on July 1, 1976, is
deleted as obsolete. However, the second
sentence of subsection (c) (1) of this section is
added to provide for the staggered appointments
required in the deleted language. Of the members
serving as of July 1, 1978, their terms expire as
follows: (1) Two members — June 30, 1979; (2) Two
members - June 30, 1980; (3) Two members — June
30, 1981; (4) Two members - June 30, 1982; and
(5) One member - June 30, 1983.

The only other changes are in style.

(A) REMOVAL BY GOVERNOR.

THE GOVERNOR MAY REMOVE A MEMBER OF THE STATE BOARD
FOR:

(1) IMMORALITY;
