2-106. GENERAL AUTHORITY OF DEPARTMENT.
THE DEPARTMENT HAS AUTHORITY OVER:

(1)   MATTERS OF ELEMENTARY AND SECONDARY EDUCATION THAT
AFFECT THIS STATE; AND

(2)     THE GENERAL CARE AND SUPERVISION OF PUBLIC
ELEMENTARY AND SECONDARY EDUCATION.

REVISOR'S NOTE: This section presently appears as Art.
77, §2(c).

SUBTITLE 2. STATE BOARD OF EDUCATION.

2-201. STATE BOARD ESTABLISHED.

THERE IS A STATE BOARD OF EDUCATION IN THE DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of present Art. 41, §200.

It is set forth as a separate section for
emphasis.

See also §2—102 of this title, which provides
that the State Board is the "head of the
Department".

The remainder of Art. 41, §200 is deleted as
obsolete and duplicative of §2-102(a) of this
subtitle.

2-202. MEMBERSHIP.

(A)   COMPOSITION.

THE STATE BOARD CONSISTS OF NINE MEMBERS APPOINTED BY
THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE.

(B)   QUALIFICATIONS.

(1) IN MAKING APPOINTMENTS TO THE STATE BOARD,
THE GOVERNOR SHALL CONSIDER REPRESENTATION FROM:

(I)   ALL PARTS OF THIS STATE; AND

(II) AREAS OF THIS STATE WITH CONCENTRATIONS OF
POPULATION OR UNIQUE NEEDS.

(2)    THE MEMBERS OF THE BOARD SHALL BE APPOINTED
FROM THE GENERAL PUBLIC.
