REVISOR'S NOTE: This section is new language added to
avoid unnecessary repetition in this article of
the full title "State Department of Education".

1-107. (G) ELEMENTARY AND SECONDARY EDUCATION.

"ELEMENTARY AND SECONDARY EDUCATION" MEANS EDUCATION
AND PROGRAMS OF EDUCATION FROM AND INCLUDING PRESCHOOL
THROUGH THE END OF HIGH SCHOOL AND THEIR EQUIVALENT.

REVISOR'S NOTE: This section presently appears as Art.
77, §1A(c).

1-108. (H) INCLUDES; INCLUDING.

"INCLUDES" OR "INCLUDING" MEANS INCLUDES OR INCLUDING
BY WAY OF ILLUSTRATION AND NOT BY WAY OF LIMITATION.

REVISOR'S NOTE: This section is new language added to
clarify expressly that words such as "includes"
or "including" are used in this article by nay of
illustration or expansion and not by way of
limitation or restriction.

In light of this definition, phrases such as "but
not limited to" are deleted throughout this
article as superfluous.

The Commission emphasizes, however, that the
absence of a like definition in any previously
revised article of the Code, other than
Transportation, does not mean that "includes" or
"including" is used in these articles in any
different sense or that a different legislative
intent is implied by the absence of phrases such
as "but not limited to" or the like. In these
other revised articles of the Code, the maxim of
expressio unius est exclusio alterius and
doctrines of similar implication are not in any
way intended to be made applicable by reason of
the deletion of such phrases.

1-109. (I) PERSON.

"PERSON" INCLUDES:

(1)    AN INDIVIDUAL, RECEIVER, TRUSTEE, GUARDIAN,
EXECUTOR, ADMINISTRATOR, FIDUCIARY, OR REPRESENTATIVE OF ANY
KIND AND ANY PARTNERSHIP, FIRM, ASSOCIATION, PUBLIC OR
PRIVATE CORPORATION, OR OTHER ENTITY,; AND

(2)   THIS THE STATE, ANY COUNTY, MUNICIPAL CORPORATION,
OR OTHER POLITICAL SUBDIVISION OF THIS STATE, AND ANY OF
THEIR AGENCIES OR UNITS.
