21-304. ELIGIBILITY FOR REHABILITATION.

TO BE ELIGIBLE FOR REHABILITATION AN INDIVIDUAL SHALL:

(1)       BE DISABLED; AND

(2)       BE SUSCEPTIBLE OF REHABILITATION.

21-305. INJURED WORKERS REHABILITATION.

(A)   ADMINISTRATION OF PROGRAM.

THE STATE BOARD OF EDUCATION AND THE WORKMEN'S
COMPENSATION COMMISSION SHALL ADMINISTER JOINTLY THE PROGRAM
ESTABLISHED IN THIS SECTION AND §21-306 OF THIS SUBTITLE.

(B)   INJURED WORKERS REHABILITATION COMMITTEE.

(1)    THERE IS AN INJURED WORKERS REHABILITATION
COMMITTEE.

(2)   THE COMMITTEE CONSISTS OF SIX MEMBERS, FOUR
OF WHOM ARE APPOINTED BY THE GOVERNOR. OF THE APPOINTED
MEMBERS:

(I)   ONE SHALL BE AN EMPLOYER;

(II)   ONE SHALL BE AN EMPLOYEE;

(III)    ONE SHALL BE A REPRESENTATIVE OF A
CASUALTY INSURANCE COMPANY; AND

(IV)   ONE SHALL BE A REGISTERED PHYSICIAN.

(3)    THE CHAIRMAN OF THE WORKMEN'S COMPENSATION
COMMISSION AND THE DIRECTOR OF THE DIVISION OF VOCATIONAL
REHABILITATION ARE EX OFFICIO MEMBERS.

(4)   EACH APPOINTED MEMBER SERVES FOR A TERM OF 6
YEARS, AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.
THESE TERMS ARE STAGGERED AS REQUIRED BY THE TERMS OF THE
MEMBERS SERVING ON JULY 1, 1978.

(5)    A MEMBER APPOINTED TO FILL A VACANCY IN AN
UNEXPIRED TERM SERVES ONLY FOR THE REMAINDER OF THAT TERM
AND UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.
