Subsection (b) of this section is new language
derived without substantive change from Art. 77A,

§49.

As to subsection (b) of this section, present
Art. 77A, §49 applies, on its face, only to
senatorial scholarships. However, in light of
the first amendment to the Federal Constitution,
it is believed that the public policy empowered
by present Art. 77A, §49 is applicable to all
scholarships awarded by this State.

18-104- DISCLOSURE OF GRADES OF SCHOLARSHIP STUDENTS TO
SPONSORS.

IF REQUESTED BY THE DONOR OR SPONSOR, ANY PUBLIC
INSTITUTION OF HIGHER EDUCATION SHALL REPORT THE ACADEMIC
GRADES OF THE RECIPIENT OF A SCHOLARSHIP TO THE DONOR OR
SPONSOR AT THE END OF EACH SEMESTER.

REVISOR'S NOTE: This section presently appears as Art.
77A, §58.

The only changes are in style.

18-105. REFUND WHERE RECIPIENT WITHDRAWS.

(A)   REFUND.

IF, DURING AN ACADEMIC YEAR, A STUDENT WHO IS RECEIVING
ANY AWARD UNDER THIS TITLE WITHDRAWS FROM THE INSTITUTION AT
WHICH THE AWARD IS USED OR OTHERWISE FAILS TO REMAIN
ELIGIBLE FOR THE AWARD, THE INSTITUTION SHALL MAKE A PRO
RATA REFUND TO THE STATE SCHOLARSHIP BOARD OR OTHER DONOR ON
THE SAME TERMS THAT IT MAKES REFUNDS TO STUDENTS.

(B)   DISPOSITION OF REFUND.
ANY REFUND MAY BE REAWARDED ON AN INTERIM BASIS UNDER

THIS TITLE UNTIL THE END OF THE ACADEMIC YEAR. ANY
REQUIREMENT OF AN EXAMINATION IS WAIVED FOR THE RECIPIENT OF
AN INTERIM AWARD.

REVISOR'S NOTE: This section is new language that
combines without substantive change Art- 77A, §§
39 and 57(g).

Present Art. 77A, §39 specifies time limits
within which the refund is to be made. These
time limits are deleted as unnecessary in light
of the power of the State Scholarship Board to
adopt rules and regulations and for consistency
with present Art. 77A, §57(g).
