16-407. TUITION AND FEES — NONRESIDENT STUDENTS.

(A)        OUT-OF-STATE STUDENTS.

ANY STUDENT WHO ATTENDS A COMMUNITY COLLEGE IN THIS
STATE AND IS NOT A RESIDENT OF THIS STATE SHALL PAY, IN
ADDITION TO THE STUDENT TUITION AND FEES PAYABLE BY A COUNTY
RESIDENT, AN OUT-OF-STATE FEE, EQUAL TO THE STATE SHARE AND
THE COUNTY SHARE PER FULL-TIME EQUIVALENT STUDENT AS
DETERMINED UNDER §16-403 OF THIS SUBTITLE.

(B)        OUT-OF-COUNTY OR REGION STUDENTS.

ANY STUDENT WHO ATTENDS A COMMUNITY COLLEGE NOT
SUPPORTED BY HIS COUNTY SHALL PAY, IN ADDITION TO THE
STUDENT TUITION AND FEES PAYABLE BY A RESIDENT OF A COUNTY
THAT SUPPORTS THE COMMUNITY COLLEGE, AN OUT-OF-COUNTY OR
OUT-OF-REGION FEE EQUAL TO THE COUNTY SHARE PER FULL-TIME
EQUIVALENT STUDENT AS DETERMINED UNDER §16-403 OF THIS
SUBTITLE.

(C)   POWER OF COUNTY TO APPROPRIATE.

ANY COUNTY MAY APPROPRIATE MONEY TO PAY THE

OUT-OF-COUNTY OR OUT-OF-REGION FEES FOR COUNTY   RESIDENTS    WHO

ATTEND A COMMUNITY COLLEGE IN THIS STATE THAT IS NOT
SUPPORTED BY THAT COUNTY.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 77A, §7(e).

The word "county" is substituted for the     present

reference to "political subdivision".      In this

regard, see §1—101 of this article which      defines
"county" as including Baltimore City.

16-408. BIDS AND CONTRACTS.

(A) APPLICATION OF SECTION.

(1)           EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, THIS SECTION APPLIES TO EVERY CONTRACT FOR ANY
BUILDING, IMPROVEMENT, EQUIPMENT, OR SUPPLIES THAT WILL COST
MORE THAN $5,000.

(2)   THIS SECTION DOES NOT APPLY TO:

(I)   THE PURCHASE OF BOOKS OR OTHER MATERIALS FOR
INSTRUCTION;

(II)     EMERGENCY REPAIRS REQUIRED DURING THE
REGULAR ACADEMIC YEAR; OR
