Article 77A, §15(a), which provides for the merger of
the University of Maryland and the Maryland State College of
Agriculture, is deleted as obsolete. The merger referred to
has been completed.
Article 77A, §15(d), which authorizes the Board of
Regents to lease the wind tunnel at College Park to any
person, including the Glenn L. Martin Company, is deleted as
unnecessary in light of the general power of the Board of
Regents to manage the University under §13-104(b) of this
subtitle.
The University researched the legislative history of
§15(d) for the Commission and informed the Commission that
§15(d) should be repealed as unnecessary.
Article 77A, §15(f), which makes the University of
Maryland-Baltimore County an integral part of the University
is deleted as obsolete, since the integration has occurred,
and as unnecessary in light of §13-104(f) of this subtitle,
which recognizes the Baltimore County Campus as no different
from any other branch of the University.
The provisions of Art. 77A, §§ 16, 17, and 20 through
27AD, which deal with the issuance of bonds by the
University of Maryland, are transferred to the Session Laws.
This transfer will not affect in any manner the power
of the institution to issue these bonds or any of its other
powers under these statutes.
There is no reason to codify revenue bond
authorizations such as these. These statutes are seldom
consulted by the public and only infrequently by those
concerned with bond transactions.
Most bond bills are found in the printed Session Laws,
not in the Code.
Article 77A, §§27AF through 27AL on the Maryland Fire
and Rescue Institute and §§ 92 through 95 on the Maryland
Fire—Rescue Training Commission are transferred to Art. 38A
of the Code for eventual inclusion in the Public Safety
Article.
Article 77A, §27AE, which deals with tuition waivers
for would be teachers is transferred to the Session Laws.
Tuition waivers have not been granted since October, 1972,
except for those students receiving waivers at that time.
Presumably, all students receiving waivers have or will have
graduated by July 1, 1978. However, since all may not have
fulfilled their service obligations, these subsections are
not repealed.
