13-108. COMPREHENSIVE LIABILITY INSURANCE; DEFENSE OF
SOVEREIGN IMMUNITY.

(A)   COMPREHENSIVE LIABILITY INSURANCE.

THE BOARD OF REGENTS MAY CARRY COMPREHENSIVE LIABILITY
INSURANCE TO PROTECT THE BOARD, ITS AGENTS AND EMPLOYEES,
AND THE AGENTS AND EMPLOYEES OF ANY INSTITUTION UNDER ITS
JURISDICTION. THE PURCHASE OF THE INSURANCE IS FOR AN
EDUCATIONAL PURPOSE AND IS A VALID EDUCATIONAL EXPENSE.

(B)   STANDARDS OF POLICIES; COVERAGE.

THE BOARD MAY ADOPT STANDARDS FOR THE COMPREHENSIVE
LIABILITY INSURANCE INCLUDING A MINIMUM LIABILITY COVERAGE
WHICH MAY NOT BE LESS THAN $100,000 PER OCCURRENCE. ANY
POLICY PURCHASED AFTER THE ADOPTION OF THESE STANDARDS
SHALL CONFORM TO THEM.

(C)   SELF-INSURANCE.

THE BOARD COMPLIES WITH THIS SECTION IF IT IS
SELF-INSURED, FOR AT LEAST $100,000 AND NOT MORE THAN
$500,000 PER OCCURRENCE, UNDER THE RULES AND REGULATIONS OF
THE STATE INSURANCE COMMISSIONER.

(D)      DEFENSE OF SOVEREIGN IMMUNITY.

THIS SECTION DOES NOT PREVENT THE      BOARD, ON ITS OWN

BEHALF, FROM RAISING THE DEFENSE OF  SOVEREIGN IMMUNITY TO

ANY AMOUNT OF A CLAIM IN EXCESS OF THE   LIMIT OF AN INSURANCE
POLICY.

REVISOR'S NOTE: This section presently appears as Art.
77A, §15A.

The only changes are in style.

It should be noted that this section presently is
dormant. Due to the state of the insurance
market, the Board is unable to obtain coverage at
a reasonable price. Nevertheless, the Board of
Regents and the State Treasurer's office feel
that the market will change in the future and the
Board will be able to comply with the section.
For this reason, this section is retained.
