(3) THE TERM "APPLICANT FOR EMPLOYMENT OR

PROSPECTIVE EMPLOYMENT OR ANY EMPLOYEE" AS USED IN THIS

SUBTITLE DOES NOT__INCLUDE A LAW ENFORCEMENT OFFICES AS

DEFINED IN § 727 OF ARTICLE 27, OR ANY EMPLOYEE OF ANY LAW
ENFORCEMENT AGENCY OF THE STATE Of MARYLAND, OR ANY COUNTY,
INCORPORATED CITY OR TOWN, OR OTHER MUNICIPAL CORPORATION.

(b) An employer may not demand or require any
applicant for employment or prospective employment or any
employee to submit to or take a polygraph, lie detector or
similar test or examination as a condition of employment or
continued employment. The prohibition of this section does
not apply to the federal government or any agency thereof
[or the State government or any agency or local subdivision
thereof, including, but not limited to, counties, city and
counties, cities, districts, authorities, and agencies].

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Education Article — Corrections

FOR the purpose of altering a certain provision of the
Education Article to conform more closely with the
provisions of the source law pertaining to higher
education and the state of the law generally.

BY repealing and reenacting, with amendments,

Section 13-104(a)
Annotated Code of Maryland

(As enacted by Chapter _____ of the Acts

of the General Assembly of 1978)

Preamble

Questions have arisen as to the meaning of §13-104(a)

of the Education Article, specifically whether the language

of that section subjects the University of Maryland only to

those statutory provisions that refer to it by name. The

General Assembly does not intend, through code revision, to
change the substantive meaning of the law, nor to enlarge or

diminish the autonomy of the University of Maryland, and

therefore adopts this Act.
