(B) BOARD MAY NOT ALTER BUDGET.

THE BOARD MAY NOT REDUCE, INCREASE, OR MODIFY THE
OPERATING BUDGET REQUESTS OF THESE INSTITUTIONS AND
AGENCIES, BUT SHALL INCLUDE ANY RECOMMENDATIONS AS TO THEM
WHEN IT SUBMITS THE CONSOLIDATED OPERATING BUDGET.

REVISOR'S NOTE: This section presently appears as Art,
77A, §31 (b) (2) and (3).

12-108. AUTHORITY OF BOARD ON CAPITAL BUDGET AND PROGRAMS.

(A)        GENERAL POWER.

IN COOPERATION WITH THE DEPARTMENT OF      STATE PLANNING,

AND WITHOUT AFFECTING THE AUTHORITY OR    RESPONSIBILITY OF

THAT DEPARTMENT UNDER ARTICLE 88C OF THE      CODE, THE STATE
BOARD FOR HIGHER EDUCATION SHALL:

(1)    REVIEW PROPOSALS FOR CAPITAL PROJECTS AND
IMPROVEMENTS PROPOSED BY THE PUBLIC INSTITUTIONS OF HIGHER
EDUCATION IN THIS STATE, AND BY PRIVATE INSTITUTIONS OF
HIGHER EDUCATION SEEKING STATE FUNDS FOR CAPITAL PROJECTS
AND IMPROVEMENT; AND

(2)    DEVELOP AND SUBMIT TO THE GOVERNOR AND THE
GENERAL ASSEMBLY RECOMMENDATIONS AS TO THESE PROJECTS, WHICH
SHALL BE CONSISTENT WITH THE PLAN PROVIDED FOR IN §12-111 OF
THIS SUBTITLE.

(B)   MATTERS TO BE REVIEWED.

WITH RESPECT TO EACH PUBLIC INSTITUTION OF
POSTSECONDARY EDUCATION, THE BOARD MAY:

(1) REVIEW AND APPROVE BEFORE IMPLEMENTATION
EACH PROPOSAL FOR:

(I)   ANY NEW PROGRAM; AND

(II) ANY SUBSTANTIAL EXPANSION, CURTAILMENT, OR
DISCONTINUANCE OF ANY EXISTING PROGRAM;

(2)    REVIEW AND MAKE RECOMMENDATIONS ON THE
CONTINUATION, MODIFICATION, OR DUPLICATION OF EXISTING
PROGRAMS;

(3)   ESTABLISH GENERAL GUIDELINES FOR TUITION AND
FEES FOR CONSIDERATION BY THE GOVERNING BOARDS OF THE
INSTITUTIONS;

(4) ESTABLISH AND IMPLEMENT:

(I) PROCEDURES FOR TRANSFER OF STUDENTS AND
FACULTY BETWEEN INSTITUTIONS;
