AN ACT concerning
Probation Before Entry of Judgment - Waiver
of Appeal
FOR the purpose of providing that a criminal defendant who
consents to and receives a stay of entering of a
judgment waives all rights to appeal from the judgment
of of guilt by the court at any time; and requiring the
court to notify the defendant that consent to the stay
of entering the judgment is a waiver of all rights to
appeal from the judgment.
BY repealing and reenacting, with amendments,
Article 27 - Crimes and Punishments
Section 292(b) and 641
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 27 - Crimes and Punishments
292.
(b) Whenever any person who has not previously been
convicted of any offense under this subheading or under any
prior law of this State or the laws of the United States or
of any other state relating to controlled dangerous
substances defined in this subheading, pleads guilty to or
is found guilty of any of the offenses specified in this
subheading, the court, if satisfied that the best interests
of the person and the welfare of the people of this State
would be served thereby, may, with the consent of such person
stay the entering of the judgment of guilt, defer further
proceedings, and place such person on probation subject to
such reasonable terns and conditions as may be appropriate
and may in addition require that such person undergo
inpatient or outpatient treatment for drug abuse. BY
CONSENTING TO AND RECEIVING A STAY OF ENTERING OF THE
JUDGMENT OF GUILT AS PROVIDED BY THIS SUBSECTION, THE PERSON
WAIVES ALL RIGHTS TO APPEAL FROM THE JUDGMENT OF GUILT BY
