USING MEDICAL INFORMATION WHICH BEARS A DIRECT, MATERIAL.

AND TIMELY RELATIONSHIP TO THE EMPLOYEE'S FITNESS OR

CAPACITY TO PROPERLY PERFORM THE ACTIVITIES OR

RESPONSIBILITIES__OF HIS POSITION; OR FROM USING MEDICAL

INFORMATION WHICH IS SUBSTANTIALLY DIFFERENT FROM THAT WHICH
IS FALSELY PROVIDED BY AN EMPLOYEE IN AN APPLICATION FOR
EMPLOYMENT.

(b) Any employee who believes that he has been
discharged or otherwise discriminated against by any person
in violation of this section may, within thirty days after
[such] A violation occurs, file a complaint with the
Commissioner, in writing and acknowledged by [said] THE
employee, alleging [such] THE discrimination. Upon receipt
of the complaint, the Commissioner shall cause [such] AN
investigation to be made as he deems appropriate. Within
ninety days of the receipt of a complaint filed under this
section, the Commissioner shall notify the complainant of
[his] THE determination under this subsection (b). If upon
[such] investigation, the Commissioner determines that the
provisions of this section have been violated, he shall file
a petition in any circuit court of the political subdivision
in which (1) the alleged violation occurred or (2) where the
employer has its principal office or (3) in the Circuit
Court for Baltimore City, as the case may be, to restrain
[said] THE violation of subsection (a) of this section and
for other appropriate relief including rehiring or
reinstatement of the employee to his former position with
back pay.

SECTION 2. AND BE II FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

AN ACT concerning

Hospital Patient's Bill of Bights

FOR the purpose of requiring each hospital to post a copy of
the Hospital Patient's Bill of Bights which it has
adopted pursuant to the Joint Commission on
Accreditation of Hospitals' guidelines in a conspicuous
place in each patient room; and making the hospital
administrator responsible for posting the notice.
