(b) The provisions of this section shall be broadly
construed and strictly enforced for the purpose of
preventing those persons in public service from securing any
pecuniary advantages, however indirect, from their public
associations, other than their compensation provided by law.
In order, however, to guard against injustice, the county
council may, by resolution, specifically authorize any
county officer or employee to receive a gift, to own stock
in any corporation or to maintain a business connection with
any person dealing with the county if, on full public
disclosure of all pertinent facts to the county council by
such officer or employee, the council shall determine that
such stock ownership, gift or connection does not violate
the public interest.
(c) Except as provided in paragraph (b) of this
section, it shall be unlawful for any person to offer, pay,
refund or rebate any part of any fee, commission or other
form of compensation or to offer or give anything of value
to any officer or employee of the county in connection with
any county business or proceeding. Any violation of this
section shall be punishable by a fine not to exceed one
hundred dollars or imprisonment of not more than six months,
or both.]
(D) AFTER JULY 1, 1978, SUBSECTIONS (A), (B) AND (C)
DO NOT APPLY TO ELECTED OFFICIALS OR EMPLOYEES OF THE COUNTY
GOVERNMENT, THE REVENUE AUTHORITY, THE HOUSING OPPORTUNITIES
COMMISSION OR THE VARIOUS FIRE DEPARTMENTS OF MONTGOMERY
COUNTY.
SECTION 2. AND BE IT FURTHER ENACTED, That all public
local laws or parts thereof enacted by the Acts of the
General Assembly, inconsistent with this Act are repealed to
the extent of the inconsistency.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July June 1, 1978.
