AN ACT concerning
Montgomery County - Interests in Contracts
and Purchases

FOR the purpose of repealing altering the Public Local Laws
of Montgomery County enacted by the Acts of the General
Assembly relating to the interests of salaried County
Officials or employees paid with County funds in
contracts to which Montgomery County or the County
Board of Education is a party; and repealing all public
local laws enacted by the Acts of the General Assembly
inconsistent with this Act.
BY repealing and reenacting, with amendments.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Code of Public Local Laws
of Maryland enacted by the Acts of the General Assembly be
repealed, amended, or enacted to read as follows:
Article 16 — Montgomery County
[11B-44.
(a) It shall be unlawful for any member of the county
council or of the county board of education or for any other
salaried county official or employee paid with county funds
to be directly or indirectly interested, in any contract or
purchase involving the expenditure of public funds to which
the county or such board is a party; or to accept or receive
from any person to which any contract or purchase may be
awarded any money, rebate, gifts or anything of value or any
promise, obligation or contract for future reward or
compensation, except for bona fide services performed and
totally unconnected with such contract or purchase; and any
member of such council or board or any other salaried county
official or employee paid with county funds so interested or
accepting or receiving gratuities or promise of gratuities
shall re deemed guilty of a misdemeanor and, upon conviction
therefor shall forfeit his office or position and be subject
to a fine not to exceed one thousand dollars or imprisonment
in the state house of correction for a term not to exceed
one year.
