SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 73B - Pensions

9.

(18) ANY PERSON WHO:

(A) IS EMPLOYED BY A MEMBER OF THE SENATE OR
HOUSE OF DELEGATES OF MARYLAND, A STANDING COMMITTEE OR
DELEGATION OF THE SENATE OR HOUSE OF DELEGATES, THE OFFICE
OF THE SECRETARY OF THE SENATE OR THE CHIEF CLERK OF THE
HOUSE OF DELEGATES, OR THE OFFICE OF THE ASSISTANT TO THE
PRESIDENT OF THE SENATE AND SPEAKER OF THE HOUSE OF
DELEGATES, OR ANY DIVISION WITHIN THAT OFFICE; AND

(B) A MEMBER OF THE EMPLOYEES' RETIREMENT

SYSTEM; AND

(C) WORKS ON A FULL-TIME BASIS FOR THE DURATION

OF THE ANNUAL REGULAR SESSION OF THE GENERAL ASSEMBLY AND

CONTINUES TO WORK AT LEAST ONE DAY BUT NOT MORE THAN THREE

DAYS PER WORK WEEK DURING THE REMAINDER OF THE CALENDAR YEAR

(B) WORKS AT LEAST 130 DAYS PER YEAR AS A

LEGISLATIVE EMPLOYEE IS CONSIDERED TO BE A PERMANENT

PART-TIME LEGISLATIVE EMPLOYEE AND SHALL RECEIVE A FULL YEAR
OF RETIREMENT SERVICE CREDIT. IF SUCH AN EMPLOYEE BECOMES A
MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM, THAT PERSON
SHALL RECEIVE THE RETIREMENT SERVICE CREDIT PROVIDED BY THIS
SECTION IF HE OR SHE DEPOSITS WITH THE RETIREMENT SYSTEM,
WITH INTEREST TO DATE OF DEPOSIT, THE CONTRIBUTIONS WHICH
WOULD HAVE BEEN MADE IF HE OR SHE HAD BEEN A MEMBER DURING
THE TIME OF PREVIOUS SERVICE.
