permanent planning agency for any region that shall include
Prince George's County, ] A LICENSE MAY NOT BE ISSUED TO A
PERSON PROPOSING TO OPEN OR CONTINUE THE OPERATION OF ANY
HOSPITAL OR RELATED INSTITUTION WHICH HAS NOT RECEIVED A
CERTIFICATE OF NEED FROM THE MARYLAND HEALTH PLANNING AND
DEVELOPMENT AGENCY AS REQUIRED BY ARTICLE 41, §§ 59C THROUGH
59L OF THIS CODE.

[(c) Review of application filed under this section by
an area-wide health planning agency for certification
recommendation shall consume no more than 90 days from the
date of application registration for the review and
recommendation.

(d) Proprietary related institutions that are
constructing a new facility or modifying an existing
facility whose applications for licensure for the ensuing
year therefrom are on record on or before April 1, 1972, are
exempt from the provisions of this section.]

[(a) The State Board of Health and Mental Hygiene is
hereby designated as the sole agency to represent the State
of Maryland for the purposes of Title VI of the Public
Health Service Act, as enacted by the Congress of the United
States, and all amendments thereof and additions thereto,
providing grants to states for the construction and
reconstruction of hospitals and related facilities. There
is hereby conferred upon the State Board of Health the
powers necessary for it to comply with the provisions
relating to the sole State agency representing the State of
Maryland for the purposes stated in said act and all
amendments thereof and additions thereto, and contained in
any part of said Title VI, and all amendments thereof and
additions thereto.]

567.

[(a) The Secretary of Health and Mental Hygiene shall
appoint twenty-four persons to an Advisory Council on
Hospital Construction to consult with and advise the
Secretary in his administration of a State plan for the
construction and reconstruction of hospital facilities as
provided for in said Public law 725 of the 79th Congress of
the United States.

(b) The term of office of the appointed members of
the Advisory Council shall be three years.

(c) Three members of said Advisory Council shall be
appointed from a list of names submitted by the medical and
chirurgical faculty of Maryland; four members shall be
appointed from a list of names submitted by the Hospital
Council of Maryland, Inc., at least two of whom shall be
physicians; one shall be a person who has been an owner or
administrator of a licensed nursing home within the State of
