Ch. 886

IS UNAVAILABLE AND HAS NOT GIVEN THE NOTIFICATION PROVIDED
IN SUBSECTION (A), THE PRESIDING OFFICERS OF THE GENERAL
ASSEMBLY, IN WRITING, MAY MAKE A FORMAL DETERMINATION OF THE
UNAVAILABILITY OR INCAPACITY OF THE TREASURER THAT INABILITY
OR UNAVAILABILITY AND APPOINT AN ACTING TREASURER.

(C) UPON PETITION OF THE TREASURER, THE ACTING
TREASURER, OR THE PRESIDING OFFICERS OF THE GENERAL
ASSEMBLY, THE COURT OF APPEALS HAS EXCLUSIVE ORIGINAL
JURISDICTION TO MAKE DETERMINATIONS OF ISSUES ARISING UNDER
THIS SECTION AND TO ENTER APPROPRIATE ORDERS.

(D) ANY PERSON SERVING AS ACTING TREASURER SHALL HAVE

THE POWERS AND DUTIES OF THE OFFICE OF TREASURER. THE

ACTING TREASURER SHALL SERVE AS TREASURER UNTIL A STATEMENT

IN WRITING HAS BEEN MADE BY THE PARTY INITIATING THE
TREASURER'S TEMPORARY REPLACEMENT, DETERMINING THAT THE
TREASURER IS ABLE TO RESUME THE DUTIES OF HIS OFFICE.
WRITTEN NOTICE OF SUCH A DETERMINATION SHALL BE GIVEN TO ALL
PARTIES.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect contingent upon the adoption of an
amendment to the Constitution of Maryland as enacted by

Chapter____of the Acts of ____ (HB____(LR0470) of 1978);

and if the proposed Constitutional Amendment is rejected by
the qualified voters of Maryland, then this Act shall become
null and void without the necessity of further action by the
General Assembly.

SECTION 3.      AND BE IT FURTHER ENACTED, That subject to

the contingency      in Section 2, this Act shall take effect
July 1, 1978.

AN ACT concerning

Disability of State Comptroller

FOR the purpose of providing for an Acting Comptroller in
the event the Comptroller is becomes unable or
unavailable to perform the duties of his office under
certain circumstances; providing for the reinstatement
of the Comptroller under certain circumstances; and
providing that the Comptroller, the acting Acting
Comptroller, the Treasurer or the Governor may petition
the Court of Appeals, which is given exclusive original
jurisdiction, to adjudge the capacity of the
