(House Bill 613)

AN ACT concerning

Disability of State Treasurer

FOR the purpose of providing for an Acting Treasurer in the
event the Treasurer is becomes unable or unavailable to
perform the duties of his office under certain
circumstances; providing for the reinstatement of the
Treasurer under certain circumstances; and providing
that the Treasurer, the Acting Treasurer, the President
of the Senate, or the Speaker of the House may petition
the Court of Appeals, which is given exclusive original
jurisdiction, to adjudge the capacity of the Treasurer
adjudicate issues hereunder and to enter appropriate
orders.

Annotated Code of Maryland

(1969 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 95 — Treasurer

6A.

(A) IF THE TREASURER NOTIFIES THE PRESIDING OFFICERS
OF THE GENERAL ASSEMBLY AND THE CHIEF DEPUTY TREASURER IN
WRITING THAT HE WILL BE TEMPORARILY UNABLE OR UNAVAILABLE TO
PERFORM THE DUTIES OF HIS OFFICE, THE CHIEF DEPUTY TREASURER
SHALL SERVE COMMENCE SERVING AS ACTING TREASURER FROM THE

DATE SPECIFIED BY THE TREASURER UNLESS NOTIFIED IN WRITING

BY THE PRESIDING OFFICERS OF THE GENERAL ASSEMBLY THAT,
ACTING JOINTLY, THEY HAVE APPOINTED ANOTHER AS ACTING
TREASURER.

(B) IF THE TREASURER IS RENDERED HAS BECOME UNABLE OR
