(Senate Bill 721)

AN ACT concerning

Department of Health and Mental Hygiene
Facilities - Staffing Ratios

FOR the purpose of establishing a uniform system for
determining the number of residents in a facility
operated by the Department of Health and Mental Hygiene
on any given day and directing that the number of
residents determined by this system be the number used
in calculating staff/resident ratios.

Section 566C

Annotated Code of Maryland

(1971 Replacement Volume and 1977 Supplement)

Preamble

WHEREAS, In order for Maryland residential facilities
to receive federal funds they must maintain the
staff-to-resident ratios required by federal regulations.
Since there are various ways to determine the number of
residents in any given facility on any given day, this Act
is intended to standardize the way in which the number of
residents is determined when computing the staff-to—resident
ratio

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY Of
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

566C.

(A) WHENEVER IT IS NECESSARY TO DETERMINE THE
STAFF-TO-RESIDENT RATIO IN ANY RESIDENTIAL FACILITY OPERATED
BY THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE, THE NUMBER

OF RESIDENTS SHALL BE THE NUMBER OF PERSONS UNDER THE

JURISDICTION OF THE FACILITY ON ANY GIVEN DAY, WHETHER OR
