SECTION 3. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland be repealed, amended, or
enacted to read as follows:

Article 88B - State Police

53.

(3) Upon the application of a member or of his or her
department head, any member who has had five or more years
of creditable service may be retired by the board of
trustees on an ordinary disability retirement allowance, if
the medical board, after a medical examination of the
member, certifies that the member is mentally or physically
incapacitated for the further performance of duty, that the
incapacity is likely to be permanent, and that the member
should be retired for the good of the Department. IN NO
EVENT SHALL A MEMBER RECEIVE A DISABILITY ALLOWANCE FOR A
DISABILITY INCURRED PRIOR TO ENROLLMENT IN THE RETIREMENT
SYSTEM, EXCEPT TO THE EXTENT THAT SUCH A DISABILITY HAS
AGGRAVATED SUBSEQUENT TO THE MEMBER'S ENROLLMENT.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1978.

AN ACT concerning

Cecil County - Alcoholic Beverages (Obscene Activities)

FOR the purpose of requiring the revocation of an alcoholic
beverage license in Cecil County for certain activities
of an obscene nature occurring on premises for which
the license was issued; specifying that the holder of
the license or any person who performs any of the
listed activities shall be subject to a certain
criminal penalty; prohibiting any "bottle club" in

Cecil County from selling, serving, or keeping

alcoholic beverages on its premises; and clarifying
language.

BY adding to

Article 2B — Alcoholic Beverages

Section 32(j)

Annotated Code of Maryland

(1976 Replacement Volume and 1977 Supplement)
