PURPOSE SAID COUNCIL SHALL BE DEEMED A BODY CORPORATE, TO
OBTAIN A DECREE, ORDER, OR JUDGMENT OF THAT COURT
COMPELLING, BY INJUNCTION OR OTHERWISE, COMPLIANCE BY ANY
PERSON WITH SUCH REGULATIONS. THE COUNCIL MAY ALSO PROVIDE
THAT IF, AFTER DUE NOTICE, ANY REGULATION REQUIRING THE
REMOVAL OF UNSIGHTLY SEEDS OR DEBRIS FROM, OR THE ABATEMENT
OF ANY NUISANCE UPON, ANY PROPERTY WITHIN THE VILLAGE, IS
NOT COMPLIED WITH BY THE OWNER OF THE PROPERTY IN A
REASONABLE TIME, THE COUNCIL SHALL HAVE THE AUTHORITY TO
HAVE THE WORK DONE AT A REASONABLE PRICE AND TO ASSESS THE
COST THEREOF AGAINST THE PROPERTY OF THE DELINQUENT PARTY,
THE SAME TO BE A LIEN AGAINST SAID PROPERTY AND TO BE
COLLECTED IN THE SAME MANNER AS THE COUNTY TAXES ARE
COLLECTED AND TURNED OVER TO THE TREASURER OF THE COUNCIL.
(b) [Any justice of the peace in Montgomery County
shall have jurisdiction to try and determine any violation
of any of said regulations and to impose the penalties
thereby provided. The sheriff of said county and his
deputies and any constable in said county shall have
authority to arrest for any violation of such regulations
and to execute all writs issued by any such justice of the
peace in connection with such regulations or with the
punishments of the persons violating any of them. The
procedure shall be in accordance with that now provided for
the trial of misdemeanors by said justices of the peace and
appeals shall be allowed as in cases of misdemeanor. All
proceedings with respect to the violation of any such
regulation shall be conducted by or through and in the name
of said citizens' committee on behalf of said Martin's
Additions 1, 2, 3 and 4 to the Village of Chevy Chase.
Costs of any such proceedings may in the discretion of the
preceding justice of the peace be assessed against any
person convicted of any violation of said regulations and if
not so assessed shall be paid by said citizens* committee.]
THE COUNCIL SHALL PUBLISH ALL REGULATIONS, ADOPTED IN
ACCORDANCE WITH THIS SECTION BOTH BY DISTRIBUTING COPIES TO
THE CLERK OF THE CIRCUIT COURT OF MONTGOMERY COUNTY, TO THE
COUNTY EXECUTIVE, TO THE STATE DEPARTMENT OF LEGISLATIVE
REFERENCE, AND TO THE SECRETARY OF THE COUNTY COUNCIL, AND
BY EITHER POSTING A COPY OF THE REGULATION, AT A PROMINENT
PLACE OFFICIALLY DESIGNATED WITHIN THE VILLAGE OR MAILING A
COPY FIRST CLASS POSTAGE PREPAID TO EACH PLACE OF RESIDENCE
AND BUSINESS WITHIN THE VILLAGE, BUT FAILURE TO RECEIVE A
COPY OR OTHERWISE TO COMPLY WITH THIS SUBSECTION SHALL NOT
INVALIDATE OR BE A VALID DEFENSE TO A VIOLATION OF SUCH A
REGULATION.
67-7.
For the purpose of making the improvements provided for
in section 67-4 or for making improvements from time to time
other than maintenance and repairs, the [said citizens*
committee] COUNCIL is hereby authorized and empowered to
borrow money and otherwise contract indebtedness and
obligate [said] Martin's Additions [1, 2, 3 and 4 to the
Village of Chevy Chase] in amounts not exceeding in total at
any time ten per cent of the assessed valuation of the real
