NOTWITHSTANDING ANY PROVISION OF A GROUP OR INDIVIDUAL
POLICY, OR CONTRACT, OF ANY CERTIFICATE ISSUED THEREUNDER,
OF HEALTH AND/OR SICKNESS, AND/OR ACCIDENT, AND/OR
DISABILITY INSURANCE WHICH IS WRITTEN ON AN EXPENSE INCURRED
BASIS, DELIVERED WITHIN THE STATE, OR ISSUED TO A GROUP
WHICH IS INCORPORATED OR HAS A MAIN OFFICE LOCATED IN THE
STATE, OR COVERING PERSONS WHO RESIDE OR WORK WITHIN THE
STATE, WHENEVER SUCH POLICY, CONTRACT, OR CERTIFICATE
PROVIDES FOR REIMBURSEMENT FOR ANY SERVICE WHICH IS WITHIN
THE LAWFUL SCOPE OF PRACTICE OF A DULY CERTIFIED NURSE
MIDWIFE, THE INSURED, OR ANY OTHER PERSON COVERED BY THE
POLICY, CONTRACT, OR CERTIFICATE, SHALL BE ENTITLED TO
REIMBURSEMENT FOR SUCH SERVICE, WHETHER THE SERVICE IS
PERFORMED BY A DOCTOR OF MEDICINE OR A DULY CERTIFIED NURSE
MIDWIFE. THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL
SUCH POLICIES, CONTRACTS, OR CERTIFICATES ISSUED, RENEWED,
MODIFIED, ALTERED, AMENDED, OR REISSUED ON OR AFTER JULY 1,
1979.

Article 43 - Health

42.

(a) (2) (I) For this purpose, [he] THE SECRETARY
may contract with insurance companies, nonprofit health
service plans, or with individuals, associations,
partnerships, incorporated or unincorporated groups of
physicians, chiropractors, dentists, podiatrists,
optometrists (as defined in §372 of this article),
pharmacists, hospitals, nursing homes, nurses, opticians,
and other health practitioners duly licensed or certified in
this State who perform services upon the prescription or
referral of a physician, for the provision of care for
eligible persons. The contracts shall be for a one—year
period and may be renewed. Within the provisions of the
budget the Secretary is authorized to provide for bedside
nursing care for eligible persons.

(II) IN THIS PARAGRAPH A "NURSE MIDWIFE"
MEANS A LICENSED REGISTERED NURSE WHO HAS BEEN CERTIFIED BY
THE AMERICAN COLLEGE OF NURSE-MIDWIVES AS A NURSE MIDWIFE.
FOR THE PURPOSES OF THIS SECTION THE NURSE MIDWIFE NEED NOT
BE UNDER THE SUPERVISION OF A PHYSICIAN. THE SECRETARY MAY
CONTRACT WITH NURSE MIDWIVES FOR THE PROVISION OF CARE FOR
ELIGIBLE PERSONS, UTILIZATION OF BENEFITS UNDER THIS
PARAGRAPH BY A NURSE MIDWIFE IS SUBJECT TO A PEER REVIEW
COMMITTEE APPOINTED BY THE STATE BOARD OF EXAMINERS OF
NURSES.

294.

(a) The Board shall have the following powers and
duties:
