Article 2B — Alcoholic Beverages

46.

(a) In Anne Arundel County no A new license shall MAY
NOT be granted to sell alcoholic beverages in any building
located within 1,000 feet in a straight line from entry to
entry from a church or school, but the license of any person
now holding a license for any building located within such
distance of the grounds of a church or school may be renewed
or extended for the same building. This section does not
apply to the City of Annapolis.

This section shall not apply to any transfer or
assignment of a license located within such distance NOR TO

ANY NONPROFIT CLUB OR ORGANIZATION.

(B) SUBSECTION (A) DOES NOT APPLY TO:

(1) THE CITY OF ANNAPOLIS,

(2) ANY TRANSFER OR ASSIGNMENT OF A LICENSE
LOCATED WITHIN THE 1,000 FOOT REQUIREMENT OF SUBSECTION (A),

(3) ANY NONPROFIT CLUB OR NONPROFIT
ORGANIZATION, OR

(4) ANY RESTAURANT DESTROYED BY FIRE, FLOOD,
WINDSTORM OR ANY OTHER ACT OF GOD AND WHICH HELD A VALID
ALCOHOLIC BEVERAGE LICENSE AT THE TIME IT HAS DESTROYED IF A
NEW CHURCH OR SCHOOL HAS NOT BEEN CONSTRUCTED WITHIN THE
1,000 FOOT REQUIREMENT OF SUBSECTION (A).

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

with regard to urban renewal community development
