Annotated Code of Maryland

(1970 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 66B - Zoning and Planning

5.03.

(D) (1) IN CARROLL COUNTY, PRIOR TO ANY APPROVAL OF
A PRELIMINARY OR FINAL SUBDIVISION PLAT, THE COMMISSION
SHALL REQUIRE CERTIFICATION OF THE ADEQUACY OF PUBLIC
FACILITIES BY THE AGENCIES HAVING JURISDICTION OVER PUBLIC
FACILITIES IN CARROLL COUNTY INCLUDING, BUT NOT LIMITED TO,
THE FOLLOWING: SCHOOLS, PUBLIC WATER AND SEWERAGE
FACILITIES, POLICE PROTECTION, ROADS AND TRAFFIC CONTROL
DEVICES, STORM DRAIN FACILITIES, EMERGENCY SERVICE
FACILITIES, HEALTH CARE FACILITIES AND SOLID WASTE DISPOSAL
FACILITIES.

(2) THE COMMISSION MAY CONSIDER AND MAY USE THE
FAILURE OF ANY AGENCY OR AGENCIES TO CERTIFY THE ADEQUACY OF
ANY PUBLIC FACILITY OR FACILITIES TO SERVE A PROPOSED
SUBDIVISION AS A BASIS FOR DISAPPROVAL OF A PRELIMINARY OR
FINAL SUBDIVISION PLAT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
