Annotated Code of Maryland

(As enacted by Chapter ____ of the Acts

of the General Assembly of 1978)

SECTION 1. BE II ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter _ of the Acts of the General

Assembly of 1978) be repealed, amended, or enacted to read
as follows:

Article 73B — Pensions

103.

(b) All professional employees who entered into a
contract of employment prior to July 1, 1975 may join the
Teachers' Retirement System as established and maintained
under this subtitle if any such employee elects to do so
within one year following July 1, 1976; or they may join an
optional retirement program if adopted by the board as
provided in § 110 of this Article. All professional
employees who enter into a contract of employment after July
1, 1975 shall participate in the Teachers' Retirement System
or an optional retirement program if adopted by the Board.
Clerical employees who entered into a contract of employment
prior to July 1, 1975, May join the Teachers' Retirement
System if any such employee elects to do so [within one

year of July 1, 1976] BEFORE JULY 1, 1979. Clerical

employees who enter a contract of employment after July 1 ,
1975, shall participate in the Teachers' Retirement System.
However, any eligible PROFESSIONAL employee who joined the
Teachers' Retirement System in the period July 1, 1975, to
June 30, 1976, without exercising his option as provided in
this subsection, shall be permitted to withdraw his
accumulated contribution in the Teachers' Retirement System.
In the event a professional employee OR CLERICAL EMPLOYEE
elects not to become a member of the Teachers' Retirement
System and subsequently becomes a member, he shall not be
permitted to purchase credit for service performed prior to
his membership in said system.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
