SECTION 2. AND BE IT FURTHER ENACTED, That this Act

does not affect the term of office of the person holding the
office of State Prosecutor on the effective date of this

Act.

SECTION 3

(e) If the State's attorney within 45 days after

receipt of the State Prosecutor's findings and

recommendations fails to file charges and commence

prosecution in accordance with the recommendations, the

State Prosecutor may prosecute those criminal offenses as

set forth in his investigative report and recommendations.

HOWEVER, THE STATE PROSECUTOR MAY IMMEDIATELY PROSECUTE

CRIMINAL OFFENSES SET FORTH IN HIS INVESTIGATIVE REPORT AND
RECOMMENDATIONS IF ALLEGED TO HAVE BEEN COMMITTED BY THE
STATE'S ATTORNEY HAVING JURISDICTION OVER THE MATTER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect June 1, 1978.

AN ACT concerning

Pensions — Boards of Trustees

FOR the purpose of allowing beneficiaries of the Employees',
Teachers', and State Police Retirement Systems to serve
on the Boards of Trustees of their respective systems
and allowing beneficiaries of the Employees* and
Teachers' Retirement Systems to vote in the elections
for members of the Boards of Trustees of their
respective systems; and removing obsolete language.
