1944                                            LAWS OF MARYLAND                                     Ch. 625

FOR the purpose of prohibiting requiring employees to do
certain activities or certain electrical conducting

lines and providing a penalty for violation of this act

granting the Commissioner of Labor and Industry

authority to promulgate rules and regulations
concerning certain activities on certain electrical
conducting lines.

BY adding to

Article 100 - Work, Labor and Employment

Article 89 - Division of Labor and Industry

Section 109

Section 31(o)

Annotated Code of Maryland

(1964 Replacement Volume and 1977 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

MAINTAIN, REPAIR, CONSTRUCT, OR INSTALL ANY ELECTRICAL

CONDUCTING LINE HAVING A DIFFERENTIAL IN EXCESS OF 24,940

VOLTS BETWEEN ANY PAIR OF CONDUCTORS OR IN EXCESS OF 14,400

VOLTS BETWEEN ANY CONDUCTOR AND A GROUND, UNLESS ALL

CONDUCTORS ARE DE-ENERGIZED, OR THE WORK IS PERFORMED WITH
HOT STICK METHODS APPROVED BY THE DEPARTMENT.

      (B) ANY PERSON VIOLATING THE PROVISION OF THIS

SECTION IS SUBJECT TO A FINE OF NOT MORE THAN $1,000. WHERE

THE VIOLATION IS OF A CONTINUING NATURE, EACH DAY IT

CONTINUES SHALL CONSTITUTE AN ADDITIONAL AND SEPARATE

OFFENSE.

Article 89 - Division of Labor and Industry

WORK ON HIGH VOLTAGE LINES.

THE COMMISSIONER OF LABOR AND INDUSTRY IS AUTHORIZED TO

PROMULGATE RULES AND REGULATIONS SETTING FORTH THE

CONDITIONS UNDER WHICH AN EMPLOYER MAY REQUIRE AN EMPLOYEE

TO ERECT, MAINTAIN, REPAIR, CONSTRUCT, OR INSTALL ANY

ELECTRICAL__CONDUCTING LINE HAVING A NOMINAL VOLTAGE IN

EXCESS OF 24,940 VOLTS BETWEEN ANY PAIR OF CONDUCTORS, OR IN
EXCESS OF 14,400 VOLTS BETWEEN ANY CONDUCTOR AND A GROUND.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.

          (A) AN EMPLOYER MAY NOT REQUIRE AN EMPLOYEE TO ERECT,
