AN ACT concerning
Commission on Medical Discipline — Unprofessional Conduct
FOR the purpose of permitting the Commission on Medical
Discipline to take disciplinary action in instances
where a physician has had disciplinary action taken
against him in another jurisdiction; and providing for
admissibility of a certified copy of the judgment or
proceeding.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 43 - Health
130.
(h) When the Commission has completed its
investigation according to the process outlined herein, it
may reprimand a physician or place him on probation, revoke
or suspend his license, or dismiss the charges against the
physician for any of the causes listed below as
unprofessional conduct:
(19) ANY ACT OR OMISSION WHICH HAS RESULTED IN
DISCIPLINARY ACTION AGAINST THE PHYSICIAN BY THE LICENSING
OR DISCIPLINARY AUTHORITY OR COURT IN ANOTHER STATE,
TERRITORY, OR COUNTRY, WHICH, If COMMITTED IN THIS STATE,
WOULD BE UNPROFESSIONAL CONDUCT PURSUANT TO THIS SECTION. A
COPY OF THE JUDGMENT OR PROCEEDING UNDER THE SEAL OF THE
CLERK OF THE COURT OR A CLERK OF THE ADMINISTRATIVE AGENCY
WHICH ENTERED THE SAME SHALL BE ADMISSIBLE INTO EVIDENCE AND
SHALL CONSTITUTE PRIMA FACIE EVIDENCE OF UNPROFESSIONAL
CONDUCT UNDER THIS SECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
