AN ACT concerning
State Employees' and Teachers' Retirement Systems —
Creditable Service
FOR the purpose of correcting and clarifying certain
provisions of the State Employees' and Teachers'
Retirement Systems relating to the determination of
creditable service.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:
Article 73B — Pensions

(2) The board of trustees shall fix and determine by
appropriate rules and regulations how much service in any
year is equivalent to one year or service, but except as
otherwise provided, in no case shall more then one year of
service be creditable for all service in one calendar year.
[The board of trustees, under such rules and regulations as
it shall adopt, shall allow credit, however, to members
absent in the military service during World War I or within
the periods and under the provisions specified in § 88 of
Article 65 of the Annotated Code of Maryland (1957 Edition
as amended), for the period of their absence, provided that
such members were employees when they entered such military
service and within one year from the date of their discharge
again became employees. Service rendered for the full
normal working time in any year shall be equivalent to one
year's service. Persons holding elective or appointive
positions shall receive a full year's credit for each full
year during which such person has held or holds such
position.]
(A) A MONTH OF SERVICE MEANS A MONTH, OR ANY
PORTION OF A MONTH, PROVIDED A CONTRIBUTION FROM
COMPENSATION IS MADE IN THAT MONTH.
