1845

Every midwife who attends a mother at the birth of a
liveborn child shall make out and file a certificate of
birth as provided in [§ 21] § 17 of this article. Whenever
a midwife shall attend any mother who gives birth to a
stillborn child [he or she], THE MIDWIFE shall immediately
notify the [coroner] MEDICAL EXAMINER having jurisdiction
over the district in which such stillborn child is born, and
shall immediately file a certificate of [birth] FETAL DEATH
for such stillborn child with the registrar of vital
statistics for the district in which such child was born.

[92. ] 90.

(A)    The [State Board of Health is hereby authorized
and empowered to] SECRETARY BOARD MAY adopt rules and
regulations[, not inconsistent with law,] governing the
licensure of midwives and the practice of midwifery in this
State.

(B)    The [State Board of Health] SECRETARY BOARD shall
keep an accurate and complete register of ALL midwives[, ]
LICENSED UNDER THIS SUBTITLE and shall enforce all the
provisions of this subtitle.

[93. ] 91.

(A)         Any person who [shall violate] VIOLATES any of
the provisions of this subtitle[,] or of the rules or
regulations adopted [hereunder by the State Board of Health,
shall be] UNDER IT IS guilty of a misdemeanor and upon
conviction [shall be fined not less than five dollars nor
more than one hundred dollars, and] IS SUBJECT TO A FINE NOT
EXCEEDING $500.

(B)         IN ADDITION TO ANY OTHER PENALTIES, THE SECRETARY
BOARD MAY REVOKE THE LICENSE OF any midwife who [shall be]
twice IS convicted of a violation of the provisions of this
subtitle, or the rules or regulations adopted [hereunder,
shall in addition to the other penalties herein provided,
forfeit her license to practice midwifery and shall not be
permitted thereafter to practice in this State. Provided

that no] UNDER IT. HOWEVER, A person to whom a rule or

regulation [of said Board] has been mailed[,] prior to
the violation of such rule or regulation[ shall] MAY NOT be
prosecuted for [such THE violation [thereof].

[94.] 92.

Any midwife who shall be convicted of producing an
abortion or inducing premature labor, shall, in addition to
the other penalties provided by law, forfeit her license to
practice midwifery and shall not thereafter be permitted to
practice midwifery in this State.

93.
