AN ACT concerning

Kidney Disease Program - Billing

FOR the purpose of specifying certain time periods during
which an invoice for services shall be submitted to the
Kidney Disease Program; and, after a certain date,
prohibiting recovery of the amount from the Program and
the patient if the invoice is not submitted within
those time periods.

SECTION 1. BE II ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 43 - Health

789.

(E) (1) THE KIDNEY DISEASE PROGRAM OF THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE MAY NOT MAKE ANY
PAYMENT FOR AN INVOICE THAT IS RECEIVED MORE THAN NINE 12
MONTHS AFTER THE DATES OF THE SERVICES RENDERED, EXCEPT FOR
AN INVOICE SUBMITTED TO MEDICARE (TITLE XVIII),
INTERMEDIARIES, AND OTHER INSURANCE PROVIDERS.

(2)    AN INVOICE SHALL BE SUBMITTED TO THE KIDNEY
DISEASE PROGRAM WITHIN SIX MONTHS AFTER MEDICARE OR OTHER
INSURANCE PROVIDERS' PAYMENT OR REJECTION.

(3)    AFTER JULY 1, 1978, A PROVIDES WHO FAILS TO
SUBMIT AN INVOICE WITHIN THE REQUIRED TIME PERIOD MAY NOT
RECOVER THE AMOUNT SUBSEQUENTLY FROM EITHER THE PATIENT OR
THE KIDNEY DISEASE PROGRAM.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
